TetherTime Terms of Use (EULA)

End User License Agreement

 

Please read these Terms of Use ("Terms", "EULA") carefully before using the TetherTime mobile application ("the App", "TetherTime") operated by Tether Enterprises LLC ("us", "we", or "our").

By downloading, installing, or using TetherTime, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, or use the App.

 

1. License Grant

 

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use TetherTime on your personal mobile device solely for your personal, non-commercial use.

You May:

• Use the App for personal journaling and reflection

• Access all features included in your subscription tier

• Export your journal entries for personal backup purposes

You May Not:

• Copy, modify, or create derivative works of the App

• Reverse engineer, decompile, or disassemble the App

• Remove any copyright or proprietary notices

• Use the App for any illegal or unauthorized purpose

• Sell, rent, lease, or sublicense your access to the App

• Share your account or subscription with others

 

2. Subscription Terms

 

TetherTime offers auto-renewable subscription options to access premium features.

 

Subscription Plans

TetherTime offers the following subscription options:

• Premium Monthly Subscription: Billed monthly at the price displayed in the App, $3.99 per month. Subscription includes up to 20 journal entries per month.  

• Pro Monthly Subscription: Billed monthly at the price displayed in the App, $9.99 per month. Subscription includes unlimited journal entries per month. 

Prices are shown in your local currency and may vary by region. All prices include applicable taxes.

 

Premium Features

Premium subscription includes:

• Up to 20 journal entries per month

• Advanced prompts and reflection tools

• Photo attachments in journal entries

• Calendar integration for journaling suggestions

• Voice-to-text journaling

• Access to future premium features

Pro subscription includes:

• Unlimited journal entries per month

• Advanced prompts and reflection tools

• Photo attachments in journal entries

• Calendar integration for journaling suggestions

• Voice-to-text journaling

• Access to future premium features

 

Free Version

The free version of TetherTime includes basic journaling functionality with limitation to 4 journal entries per month. 

 

Auto-Renewal

Important: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period.

• Monthly subscriptions renew every month on the same day you originally subscribed

 

Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current subscription period at the same price you originally paid (unless pricing has changed, in which case you'll be notified in advance).

Managing Your Subscription

You can manage your subscription and turn off auto-renewal at any time through your Apple ID Account Settings:

1. Open the Settings app on your iPhone or iPad

2. Tap your name at the top

3. Tap Subscriptions

4. Select TetherTime

5. Toggle off Auto-Renewal or cancel

Turning off auto-renewal will prevent future charges, but you will retain access to premium features until the end of your current billing period.

 

Payment

Payment will be charged to your Apple ID account at confirmation of purchase. All payments are processed through Apple's In-App Purchase system. We do not have access to your payment information.

 

Price Changes

We reserve the right to change subscription prices at any time. If we increase the price of your subscription, you will be notified at least 30 days in advance through the App or via email. Price changes will not affect your current subscription period and will only apply upon renewal after you've been notified. You may cancel your subscription before the price change takes effect.

 

3. Free Trial (If Applicable)

 

If you sign up for a free trial:

• You will have access to all premium features during the trial period

• The trial length will be clearly displayed before you subscribe

• You will not be charged during the trial period

• Your subscription will automatically begin and you will be charged when the trial ends unless you cancel at least 24 hours before the trial ends

• You can cancel anytime during the trial through your Apple ID Account Settings without being charged

• Only one free trial per user; if you've previously used a trial, you will be charged immediately

 

4. Cancellation and Refunds

 

How to Cancel

You may cancel your subscription at any time by turning off auto-renewal in your Apple ID Account Settings (see "Managing Your Subscription" above). Cancellation will take effect at the end of your current billing period.

 

No Partial Refunds

If you cancel your subscription, you will not receive a refund for the current billing period. You will continue to have access to premium features until the end of the period you've already paid for.

 

Refund Requests

All purchases are processed through Apple's App Store. Refund requests must be submitted directly to Apple within 14 days of purchase:

• Visit https://reportaproblem.apple.com

• Sign in with your Apple ID

• Select "Request a refund"

• Choose TetherTime purchase and provide a reason

We do not process refunds directly. Apple's refund policies apply, and approval is at Apple's sole discretion.

 

Account Deletion

If you delete your TetherTime account or uninstall the App, your subscription will not automatically cancel. You must manually cancel your subscription through your Apple ID Account Settings to stop future charges.

 

5. App Functionality and Data

 

Local Storage

TetherTime stores all your journal entries, photos, and personal data exclusively on your device. We do not have access to your journal content and cannot recover your data if lost.

 

Your Responsibilities

You are solely responsible for:

• Backing up your data: We recommend regularly exporting your journal entries for safekeeping

• Device security: Protecting your device and PIN from unauthorized access

• Data loss: We are not liable for any data loss due to device failure, app deletion, PIN reset, or any other cause

• Accuracy: The accuracy and content of your journal entries

 

PIN Protection

If you set a PIN to protect your journal:

• You are responsible for remembering your PIN

• We cannot recover or reset your PIN without deleting all your data

• After 5 failed PIN attempts, the App will lock for 5 minutes

• If you forget your PIN, a reset is required which permanently deletes all journal data from your device

 

Data Export

You may export your journal entries as text files at any time through the App's export feature. We recommend doing this regularly as a backup.

 

No Cloud Sync

TetherTime does not offer cloud backup or sync across devices. If you use TetherTime on multiple devices, your journals will be separate on each device.

 

6. Error Monitoring (Optional)

 

TetherTime uses Sentry for optional error monitoring to improve app stability. This feature:

• Is completely optional and can be disabled in Privacy settings

• Collects only technical diagnostic information (device type, OS version, crash logs)

• Does NOT collect journal content, photos, calendar data, or personal information

• Can be enabled or disabled at any time

By using TetherTime with error monitoring enabled, you acknowledge that technical diagnostic data may be collected as described in our Privacy Policy.

 

7. Intellectual Property

 

Ownership

TetherTime, including all content, features, functionality, code, design, graphics, and user interface, is owned by Tether Enterprises LLC and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

 

Your Content

You retain all rights to your journal entries and any content you create in TetherTime. By using the App, you grant us no rights to your journal content. Your journals belong to you alone.

 

Trademarks

"TetherTime" and related logos are trademarks of Tether Enterprises LLC. You may not use our trademarks without our prior written permission.

 

8. Prohibited Uses

 

You agree not to use TetherTime:

• In any way that violates any applicable national, federal, state, local, or international law

• To transmit any malicious code, viruses, or harmful data

• To attempt to gain unauthorized access to the App or its systems

• To impersonate or misrepresent your affiliation with any person or entity

• To interfere with or disrupt the App's functionality

• For any commercial purpose without our express written consent

• To collect or harvest any information about other users

• To reverse engineer or attempt to extract the source code

 

9. Third-Party Services

 

TetherTime integrates with certain device features and third-party services:

 

Device Permissions

• Photos: To attach photos to journal entries (you select which photos)

• Calendar: To suggest journal prompts based on your activities (analyzed locally)

• Microphone: To enable voice-to-text journaling (processed on-device)

All data accessed through these permissions remains on your device and is not transmitted to our servers.

 

Third-Party Privacy Policies

We are not responsible for the privacy practices or content of third-party services.

 

10. Disclaimer of Warranties

 

TetherTime is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, or non-infringement

• That the App will be uninterrupted, error-free, or secure

• That any errors or defects will be corrected

• That the App will meet your requirements or expectations

• The accuracy, reliability, or completeness of any content in the App

Mental Health Disclaimer: TetherTime is a personal journaling tool and is NOT a substitute for professional mental health care, therapy, or medical advice. If you are experiencing a mental health crisis or emergency, please contact a qualified healthcare provider or emergency services immediately.

No Warranty for Data Loss: We do not warrant that your journal data will be preserved. You are responsible for backing up your data using the export feature.

 

11. Limitation of Liability

 

To the maximum extent permitted by law, Tether Enterprises LLC, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, use, goodwill, or other intangible losses

• Damages resulting from your use or inability to use the App

• Unauthorized access to or alteration of your data

• Data loss or corruption

• Any emotional distress or psychological harm

• Any other matter relating to the App

Our total liability to you for all claims arising out of or related to these Terms or the App shall not exceed the amount you paid to us in the 12 months preceding the claim, or $50 USD, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.

 

12. Indemnification

 

You agree to indemnify, defend, and hold harmless Tether Enterprises LLC and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App

• Your violation of these Terms

• Your violation of any rights of another party

• Your journal content or any content you submit through the App

 

13. Children's Use

 

TetherTime is intended for users aged 13 and older. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child under 13 has used the App, please contact us immediately at info@tetherenterprises.com.

If you are between 13 and 18 years old, you must have your parent or guardian's permission to use TetherTime and purchase subscriptions.

 

14. Changes to These Terms

 

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Posting the updated Terms in the App

• Updating the "Last Updated" date at the top of this document

• Displaying a notice in the App when you first open it after the update

• Sending a notification through the App or via email (if you've provided contact information)

Changes are effective immediately upon posting. Your continued use of TetherTime after changes are posted constitutes your acceptance of the updated Terms.

If you do not agree to the modified Terms, you must stop using the App and cancel your subscription.

 

15. Termination

 

Termination by You

You may stop using TetherTime at any time by:

• Uninstalling the App from your device

• Canceling your subscription through your Apple ID Account Settings

 

Termination by Us

We reserve the right to suspend or terminate your access to TetherTime at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms

• Fraudulent or illegal activity

• Abusive behavior

• Non-payment (for subscriptions)

• At our sole discretion

 

Upon termination:

• Your right to use the App will immediately cease

• All data stored on your device will remain on your device, but you will lose access to premium features

• You will not receive a refund for any unused portion of your subscription

• Provisions of these Terms that by their nature should survive termination will survive

 

16. Governing Law and Dispute Resolution

 

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions.

 

Dispute Resolution

Informal Resolution: Before filing any formal claim, you agree to contact us at info@tetherenterprises.com to attempt to resolve the dispute informally. We'll try to resolve the dispute within 30 days.

Arbitration Agreement: If we can't resolve the dispute informally, you agree that any dispute arising out of or relating to these Terms or the App will be resolved through binding arbitration rather than in court, except that:

• You may assert claims in small claims court if your claims qualify

• You or we may seek equitable relief in court for infringement or misuse of intellectual property rights

The arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You and we agree to arbitrate only on an individual basis and not as a class action or representative action.

 

Jurisdiction

For any disputes not subject to arbitration, you agree to submit to the personal jurisdiction of courts located in Salt Lake County, Utah, United States.

 

17. Severability

 

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

 

18. Waiver

 

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

 

19. Entire Agreement

 

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tether Enterprises regarding TetherTime and supersede all prior agreements and understandings, whether written or oral.

 

20. Assignment

 

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign or transfer these Terms and our rights at any time without restriction and without notice to you.

22. Apple-Specific Terms

 

Acknowledgement

You acknowledge that these Terms are concluded between you and Tether Enterprises LLC only, and not with Apple Inc. ("Apple"). Tether Enterprises LLC, not Apple, is solely responsible for TetherTime and its content.

 

Scope of License

The license granted to you is limited to a non-transferable license to use TetherTime on any Apple-branded device that you own or control and as permitted by the Usage Rules in the Apple App Store Terms of Service.

 

Maintenance and Support

Tether Enterprises LLC is solely responsible for providing any maintenance and support services for TetherTime. Apple has no obligation to furnish any maintenance or support services.

 

Warranty

Tether Enterprises LLC is solely responsible for any product warranties to the extent not effectively disclaimed in these Terms. In the event of any failure of TetherTime to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for TetherTime. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to TetherTime.

 

Product Claims

Tether Enterprises LLC, not Apple, is responsible for addressing any claims by you or any third party relating to TetherTime or your possession and/or use of TetherTime, including:

• Product liability claims

• Claims that TetherTime fails to conform to legal or regulatory requirements

• Claims arising under consumer protection or similar legislation

 

Intellectual Property Infringement

In the event of any third-party claim that TetherTime or your possession and use of TetherTime infringes that third party's intellectual property rights, Tether Enterprises LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.

 

Legal Compliance

You represent and warrant that:

• You are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country

• You are not listed on any U.S. Government list of prohibited or restricted parties

 

Third-Party Beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

 

Summary

 

By using TetherTime, you agree to:

• Subscribe to premium features with auto-renewable subscriptions processed through Apple

• Be responsible for managing and canceling your subscription through Apple

• Back up your own data, as all journal entries are stored only on your device

• Use the App responsibly and in accordance with these Terms

• Accept that we are not liable for data loss, app errors, or any damages arising from your use
